What is a leasehold?

The leasehold is the right to erect and/or maintain a building on a property in exchange for the payment of a regular leasehold fee (§ 1 Para. 1 of the Leasehold Law). From the perspective of the property owner (the grantor of the leasehold right), the leasehold is a limited real right that encumbers his property.

The leasehold arises from a leasehold contract between the leaseholder and the property owner. The leasehold is treated like a property itself (a so-called property-equivalent right). It may be sold, inherited, and encumbered like any property—for example, with mortgage rights (land charge and mortgage). It is therefore registered in its own land register sheet, the so-called leasehold land register. The leasehold expires upon the completion of the agreed period (in this case, 99 years).
