Notes on the rent cap:

There are four possible exemption cases in which the rent cap does not apply. This rental offer falls under the modernization exemption. The rent is more than 10% above the typical local comparative rent. According to § 566g of the German Civil Code (BGB), this is permissible because modernization measures were carried out in the three years prior to the start of the tenancy.
